2015년 8월부터 바뀐 영국 학생비자법
영국이민국은 2015년 8월부터 학생비자법을 기존의 규정을 좀더 강화하여 적용하는 새 규정을 시행합니다. 오늘은 이에 대해 정리합니다.
ㅁ 변경된 학생비자법의 주요골자
이미 한번 학생비자를 받은 사람은 그 학업 성취도에 따라 비자승인 여부를 결정하는 것이 강화되었습니다. 즉, 비자연장 신청 이전과정 학업성취도가 놓은 학생은 학생비자 연장이 무난하고, 학업성취도가 낮은 학생은 학생비자 연장을 제한한다는 것입니다. 이 말은 이제 학업에 열중하지 않아 과락 등 문제가 있는 경우는 비자연장이 어렵고, 그 문제가 큰 경우는 연장해 주지 않겠다는 의미입니다. 또 3년만에 학사를 마친 사람은 석사과정을 두개를 할 수 있는 기간을 여유있게 주겠다는 것입니다.
ㅁ 학업성취도와 비자연장
학업성취도(Academic progression)가 있어야 비자연장이 가능합니다. 그렇지 않으면 비자연장이 안됩니다. 예를들면A-Level을 했거나 Foundation을 한 학생이 다시Foundation을 하지 못하고, Diploma를 한 학생이 다시Diploma로 하는 경우에 비자 규정 때문에 입학을 받아 주지 않습니다.
단, 예외는 있습니다. T4C비자소지자, 해외서 학생비자를 처음신청한 경우, 현재 학교 스폰서쉽이 없어진 경우, 재시험인 경우, 박사학위과정 연장인 경우에는 예외로 적용합니다.
ㅁ 학업성취도가 좋은 경우
- A레벨이나 파운데이션을 마치고 학사과정으로 진학하는 경우.
- 프리세셔널 영어과정을 마치고 학사 / 석사 과정으로 진학하는 경우.
- 학사과정 중에 인턴쉽을 하고, 그 후 다시 그 학사과정을 연속하는 경우.
- 학사과정을 마치고 석사과정으로 진학하는 경우
- 석사과정 후 박사과정 진학하는 경우.
ㅁ 학사 후 학사과정, 석사 후 석사과정 할 경우
학사과정을 마치고 다시 학사과정을 할 경우, 혹은 석사과정을 마치고 다시 석사과정을 할 경우는 그에 합당한 직업적 필요성을 확실하게 피력해야 합니다. 이는 학교에서 그 학생을 왜 이전에 했던 동급의 학위과정을 받아 주었는지 CAS statement안에 기재해야 합니다.
예를들면, 언어학 석사과정을 마치고 또 남미문학 석사과정에 진학한 경우, 남미문학 박사과정을 하기 위해서 이전단계로 폭넓은 지식을 습득하기 위해서 석사과정부터 시작하려고 한다는 사유 등.
다른 예를들면, 환경정책학 석사과정을 마치고, 다시 경영학 석사과정을 지원한 경우, 에너지 산업분야에 좀 더 폭넓게 직업을 선택하기 위해서 경영학이 필요하다는 사유 등.
그러나 상식적으로 말이 안되는 내용을 피력하는 경우에는 거절될 수 있습니다. 이민국은 비자거절이 될 수 있는 본보기로 다음과 같은 예를 들어 놓았습니다. 예를들면, 회계학석사를 마치고 음악학석사를 하는 경우. 또 역사학 학사학위를 시작했다가 1년 후에 그만두고 영문학 학사학위로 다시 시작하려고 하는 경우 등.
ㅁ 학생비자 기간제한(Time Cap)
학생비자기간 제한 연수에 대해서는 학사 5년, 석사 2년, 박사 8년으로 기존과 같으나, 그 기간을 산정하는 방법에 있어서는 학생비자 시작전 입국하여 체류한 기간과 학업후 추가로 더 받은 비자기간까지를 모두 포함해서 위의 기간을 산정합니다.
그리고 학업성취도가 높은 학생들에 한해서 다음과 같은 융통성이 있는 비자기간을 더 줍니다. 예를들면, 학사과정(NQF Level 6)은 최대 5년이지만, 아래와 같이 학사과정에 성과가 좋은 경우, 빨리 마치는 경우, 석사기간 등에 여유롭게 적용해 줍니다.
1) 해외서 처음 5년코스 약학학위 신청하는 경우: 코스기간 57개월 + 코스전1개월 + 코스후 4개월 = 총 62개월
2) 3년학사학위 + 12개월 석사 + 다른 12개월 석사를 신청하는 경우: 학사코스기간 3년 4개월 + 석사 16개월 + 석사 16개월 = 총 65개월
3) 1년 BA수료하고 취소 후에 다른 BA학위과정 + 1년 석사과정: 총 67개월

저는 런던에 대학원 offer 를 받고 2016년으로 디퍼를 할지 말지 고민하고있던 중에
10th Aug부터 바뀌었다고 하는 연락을 6th Aug 에 받았는데요, 이야기하다보니 심각한것 같아
이번 바뀐 법에 대해 제가 어려운상황에 처해있는건지 여쭙고싶어 연락드립니다.
갑작스럽기도하고 사실 10th Aug전에 CAS를 발급받았어야 예전법에 적용된다는건지 , 비자를
신청했어야한다는건지 아님 비자를 받았어야하는건지도 불분명합니다.
(아래 내용에서는 CAS 발급 날자를 말하네요)

It is correct that the cap is extended to 6 years if you have done a 4 year undergraduate degree. (see
section 101, page 25 of the Tier 4 Policy Guidance)
In terms of the levels of study that are included in the 5/6 year cap, it is any study at degree level and
above. Therefore the Masters at the RCA is included in this time limit with the UG from UCL. (See
section 101, page 25 of the Tier 4 Policy Guidance)

The Home Office have also recently changed the way in which the 5/6 year cap is being calculated.
Under the old regulations the Home Office calculated time spent studying in the UK based upon the
term dates. Under the new rules, the Home Office are now calculating time spent in the UK based on
the time length of the Tier 4 visa. This means that they are now including the time granted before a
course starts (usually one month) and the four months after a course has finished.

Under this new way of calculating the cap, if you were to defer your place at the RCA to 2016 you
would not have sufficient time within the 6 year cap to complete the course, as the calculation would be
as follows:
Study at UCL: 13/09/2010 - 13/10/2014 (based on the visa dates, not the term dates) = 4 years 1 month
1 day
Study at RCA: 26/08/2016 - 30/10/2018 (this is with the additional 1 month at the beginning and 4
months at the end of the visa) =2 years 2 months 5 days
In total this would be 6 years 3 months and 6 days which is over the 6 year cap.
As a transitional measure the Home Office have stated that any CAS's that are issued prior to the 10th
August 2015 will be assessed under the old regulations, which calculated the time based on the course
dates not the visa dates. if you started the course this year, with a CAS issued before the 10th August
the calculation would be as follows:
Study at UCL: 26/09/2010 - 13/06/2014 (based on the term dates, not the visa dates) = 3 years 9
months 1 day
Study at RCA: 28/09/2015 - 30/06/2017 (based on the term dates, not the visa dates) = 1 year 9 months
3 days
In total this would be 5 years 6 months and 4 days which is under the 6 year cap.
