안녕하세요?
영국이민센터입니다.

학부학생으로 가족이 동반비자를 받고 있는데, 학사에서 석사과정으로 함께 가려고 하는데,  학교가 학원같은 곳에서 하는 ACCA과정이라 그런 경우에는 안되는지 궁금하시군요?

규정상으로 볼때,
석사이상으로 학생비자를 신청할 때에만 가족을 동반할 수 있다고 한 규정이 생긴지가 오래되지 않아, 그 이전에 이미 영국에 가족을 데리고 와 있는 사람에게는 해당되지 않습니다.

따라서 그런 규정은 해외에서 Visa를 신청할 때에 적용되는 조항이지, 영국내에서 신청하는 Leave to Remain(체류허가)에 대한 조항이 아닙니다.

따라서 이미 영국에 와 있는 귀하의 가정은 6개월이상 코스를 하는 경우에는 온 가족이 함께 체류허가로서 학생비자를 영국에서 신청할 수 있습니다.
그  석사과정이 정부 Fund를 받느냐 안받느냐와 상관없이 신청할 수 있습니다

안녕하세요.

남편이 학부를 이번에 마치고 석사과정을 들어가면서 비자 연장을 하려고 합니다.

저는 지금까지 남편의 학생 동반비자로 영국에 함께 있었고요.

이번에 가려는 학교가 12개월 이상짜리 석사(equivalent) 코스(ACCA)이고

highly trusted sponsor라 당연히 동반비자도 받을 수 있고 풀타임으로 일도 할수 있다고 생각했는데

이곳 질문게시판을 보다보니 헷갈려서 문의 드립니다.

알아보니 이학교가 소위 말하는 정규 university는 아니고 일종의 privately funded

institution 이라 아래에 첨부한 동반비자 규정의 (ii)번 항목은 충족시킬수 없을 것 같은데,

저희 같은 경우(영국에 이미 학생비자/동반비자로 거주중이고 6개월 이상 코스를

마쳤으며 이번에 동시에 비자신청을 하는)엔 (ii)번이 아니라  (iv)번 항목에 해당되는 상황이 맞는건지요. 확실치가 않아 불안하네요.  비슷한 케이스를 검색해봐도 안나오고...

33. You can be the family member of a Tier 4 (General) applicant where they are
applying for, or
have been granted, entry clearance, leave to enter, or leave to remain in the United
Kingdom as a
Tier 4 (General) Student if:

(ii)  the Tier 4 (General) applicant is:
   a)  applying for, or has been granted entry clearance or leave to
remain in order to undertake a course of study at post-graduate level for 12 months or
longer; and

   b)  is sponsored by a sponsor who is a Recognised Body or a body in
receipt of funding as a higher education institution from either:
     I.  the Department for employment and Learning in northern
Ireland;
     II.  the Higher education Funding Council for england;
     III.  the Higher education Funding Council for Wales; or
     IV.  the Scottish Funding Council;
or

         (iv)  the following conditions are met:

   a)  the Tier 4 (General) applicant is applying for entry clearance , leave
to enter, or leave to remain, to undertake a course of study that is longer than six
months and either:
     (1)  has entry clearance, leave to enter, or leave to remain as a
Tier 4 (General) Student or as a student to undertake a course of study longer
than six months ; or
     (2)  last had entry clearance, leave to enter, or leave to remain
within the three months preceding the application as a Tier 4 (General) Student or
       as a student to undertake a course of study longer than six
months; and

   b)  You (the family member) must either-
     (1)  have entry clearance, leave to enter, or leave to remain as a
family member of a Tier 4 (General) Student or a student with entry clearance,
       leave to enter, or leave to remain, to undertake a course of
study longer than six months; or
     (2)  have last had entry clearance, leave to enter, or leave to
remain within the three months preceding the application as the family member of a
       Tier 4 (General) Student or as a student to undertake a
course of study longer than six months; and
   c)  the Tier 4 (General) applicant Migrant and you (the family member)
must be applying at the same time.
