런던에 있는 큐가든 식물원으로 인턴쉽과정을 가는데 T5GAE비자가 가능한지 어떤 비자를 받아야 할지 궁금하시군요?
참, 어렵습니다.
이민법은 한달이 멀다하고 변하는데 구체적인 사안들을 다 포함하고 가기는 너무 벅찬가 봅니다. 그래서 법이 모든 것을 다 포함하지 않은 경우가 많아 좋은 과정을 놓치는 경우가 많아 안타까울 때가 많습니다.
ㅁ 먼저 T5GAE 규정을 살펴봅니다
What is the government authorised exchange category?
The government authorised exchange category is for people coming to the United Kingdom through approved schemes that aim to share knowledge, experience and best practice, and to experience the social and cultural life of the United Kingdom. This category must not be used to fill job vacancies or to bring unskilled labour to the United Kingdom.
Your sponsor will be an overarching body who manages the government authorised exchange scheme. This overarching body must have the support of a United Kingdom government department.
Individual employers and organisations will not be allowed to sponsor migrants in this category, even if they are licensed as sponsors under other tiers or other categories of Tier 5. The only exceptions to this are if you are coming to the United Kingdom:
- as a sponsored researcher, where the higher education institution you are coming to work at will be your sponsor; or
- to work for a government department or agency.
Any work you do must be skilled which means it must be equivalent to NVQ or SVQ level 3 or above. This is unless you are taking part in the scheme set up as part of the European Union's lifelong learning programme, where you can do vocational education and training at a lower skill level.
You are allowed to stay in the United Kingdom for up to 24 months under this category. 위의 내용에서 볼 수 있듯이, 큐가든이 스폰서쉽라이센스를 가지고 있어야 하고, 지원하신 과정이 이민국으로 부터 인정받은 과정(Approved scheme) 이어야 합니다.
제가 이민국에 큐가든 식물원이 스폰서쉽라이센스를 어떤 것을 받았는지 체크해 보니, T2General과 T5 Voluntary Workers 등 두가지만 승인되어 있습니다. 즉, T5GAE는 승인된 것이 없습니다.
그렇다면, 현실적으로 그곳으로 가려면 가능한 것으로 하려면 T5 Voluntary Workers로 신청할 수 있는지를 검토해 보셔야 할 것입니다.
그럼 그에 대한 규정을 검토해 봅니다.
What is the charity worker category?
The charity worker category is for people coming to the United Kingdom to do voluntary work for charity, which is not paid work. The work must be directly related to the work of your sponsor?s organisation.

Who can apply as a charity worker?
Before you apply under the charity worker category, you must have:
- a sponsor; and
- a valid certificate of sponsorship.
When you apply you are awarded points based on your sponsorship and available maintenance (funds). (85)
You can apply under the charity worker category now if you are:
- applying for permission to enter the United Kingdom (known as 'entry clearance') under the charity worker category;
- already in the United Kingdom as a charity worker and want to extend your permission to stay if you have been here for less than 12 months, which is the maximum time you are allowed to stay.
Switching is not allowed in or out of the charity worker category.

안녕하세요.
Tier 5 Government authorised exchange 비자에 관해 몇가지 궁금한 사항이 있어서요.
저는 내년 런던으로 식물원 인턴쉽 코스를 밟고자 준비중인 학생입니다.
영국 큐식물원(Royal botanic garden Kew)에서 식물원관리와 관련한 3개월 인턴쉽코스로 정식명칭은 -Kew's Voluntary Horticultural Internship Programme-입니다.
원래는 관광비자를 통해 영국에 6개월 머무르는 동안 3개월과정의 본 식물원 인턴쉽 코스를 수료하려고 했는데, 관광비자법에 인턴쉽을 포함하여 employment와 관련한 모든 것은 허락되지 않는다고 하기에 영국비자센터에서 관광비자를 통한 인턴쉽은 허락되지 않는다고 하더군요..
그러나 제가 이수하고자하는 인턴쉽코스는 식물원의 일자리를 차지하는 것이 아닌, 일종의 원예관리프로그램을 수료하는 것인데,, 이 프로그램의 이름이 Internship 이다 보니 문제가 되는 것 같습니다.
그래서 인턴쉽과 관련한 비자를 알아보던 중 인턴쉽과 관련하여 받을 수 있는 비자는 Tier4, Tier5인데,, 저는 학업과 연관하지 않고, 바로 인턴쉽 코스를 밟고자하기에, Tier5 단기취업비자가 해당이 되는 것 같습니다.
Tier 5 Government authorised exchange 가 "영국으로 지식, 경험과 최상의 실습을 공유하고자 승인된 과정을 이수하려는 신청자" 라고 명시된 것을 보면,제가 선택할 수있는 비자인것 같은데요.. 혹 이 비자가 영국대학연구소의 연구원으로 갈 경우만 해당되는 것인지 궁금해서 문의드리게 되었습니다. 즉 T5 GAE는 연구원으로 갈경우만 해당되는 것인지요?
제가 지원한 식물원은 영국왕립에서 주관하는 식물원이고, 이 식물원에서 제공하는 인턴쉽 프로그램(식물원에 고용되는 것이 아님)을 이수하고자 가는 경우 T5 GAE 비자가 해당될 수 있지 않은지 궁금합니다.
그리고, 어떤 글에서는 재정증명과 관련하여 한국에서 신청할 경우는 2800파운드가 3개월간 유지되어야 하고, 영국에서 신청할 경우는 800파운드로 명시되어있는데, 한국에서 신청할 경우도 3개월간 최소 800파운드만 유지되면 되는것이 아닌지 궁금합니다.
복잡하게 설명드렸는데요,, 요약하자면,
1. 식물원 인턴쉽코스인 경우, Tier 5 Government Authorised exchange 비자가 해당될 수 있는지,
2. 재정증명과 관련하여 한국에서 신청할 경우도 3개월간 최소 800파운드만 유지되면 되는것이 아닌지,
3. 관광비자의 경우 employment와 관련한 인턴쉽이 아닐경우는 신청할 수 있지않을지,
4. student visitor 는 해당될 수 없는지,
알려주시면 감사하겠습니다.
참고로, 식물원 측으로 부터 인턴쉽에 관한 허가는 받은 상황입니다.
